Welcome to Atelier Sébeline.
The terms “we,” “us,” and “our” refer to Atelier Sébeline. Atelier Sébeline operates this website and online store, including all related information, content, features, products and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”), together with the policies referenced herein, govern your access to and use of the Services and your purchases from Atelier Sébeline.
By accessing or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, you should not use the Services.
Nothing in these Terms limits any rights or remedies that cannot legally be excluded under applicable consumer protection laws.
SECTION 1 — ELIGIBILITY AND ACCOUNT INFORMATION
By using the Services, you represent that you are at least the age of majority in your province, state or country of residence, or that you have the consent required by applicable law.
When placing an order, you agree to provide accurate, current and complete information, including your email address, billing information, shipping information and any information necessary to create your personalized artwork.
You are responsible for maintaining the confidentiality of any account credentials associated with the Services.
SECTION 2 — PERSONALIZED ARTWORK
Atelier Sébeline creates personalized artwork based on photographs supplied by customers.
Each artwork is individually created and may involve artistic interpretation of the original photograph. Variations in line, color, composition, texture and artistic details are inherent to the creative process and to the artistic style selected.
Images displayed on our website are intended to represent our artistic styles. Because every artwork is personalized, your finished artwork will be unique.
Colors may also vary slightly between digital screens and the final printed product due to differences in displays, printing processes, materials and lighting.
SECTION 3 — CUSTOMER PHOTOGRAPHS AND CONTENT
By uploading or otherwise providing a photograph, image or other content to Atelier Sébeline, you confirm that you own the content or have the necessary permission and rights to provide it to us and to authorize its use for your order.
You grant Atelier Sébeline a limited license to use the content solely as reasonably necessary to create, process, produce and fulfill your personalized artwork and provide related customer service.
We will not use your personal photographs or personalized artwork for advertising, social media, promotional materials, portfolio displays or other public marketing purposes without your separate permission.
You remain the owner of your original photograph and content.
We reserve the right to decline content that we reasonably believe is unlawful, infringes third-party rights, or cannot appropriately be used to fulfill the requested order.
SECTION 4 — DIGITAL PROOF AND APPROVAL
After you place your order, Atelier Sébeline will create a digital proof of your personalized artwork.
We aim to provide the initial digital proof within 1–2 business days.
You are responsible for reviewing the proof carefully before approving it, including the composition, subjects, artistic interpretation and other visible details.
If adjustments are needed, you must request them before approving the proof.
Your artwork will not be sent to production until you approve the final digital proof.
Once you approve the proof, your artwork may enter production and generally can no longer be modified or cancelled, except where required by applicable law.
SECTION 5 — ORDERS AND CANCELLATIONS
When you submit an order, you agree to pay the prices, shipping charges and applicable taxes displayed during checkout.
If you wish to cancel an order, please contact us as soon as possible at contact@ateliersebeline.com.
Because work on personalized artwork may begin shortly after an order is placed, voluntary cancellations may only be possible before creation of the artwork has begun.
Once the final digital proof has been approved and the order has entered production, the order generally cannot be cancelled or changed.
This commercial cancellation policy does not limit any cancellation rights that may apply under mandatory consumer protection laws.
SECTION 6 — RETURNS, REFUNDS AND PERSONALIZED PRODUCTS
Because Atelier Sébeline products are custom-created specifically for each customer, personalized products generally cannot be returned or exchanged because of a change of mind, personal preference or an error in the photograph or information supplied by the customer after the final digital proof has been approved.
Damaged, defective or incorrect products will be handled in accordance with our Return and Refund Policy.
Nothing in this section limits any rights or remedies available to you under applicable consumer protection laws.
SECTION 7 — PRICES, CURRENCY AND PAYMENT
Prices and promotions may change without notice.
The price applicable to your order is the price presented during checkout when the order is submitted.
Depending on your location, prices may be displayed in a local currency. Currency conversions may be performed by Shopify or our payment providers.
Shipping charges and applicable taxes are displayed during checkout where applicable.
You agree to provide valid and accurate payment information and represent that you are authorized to use the payment method provided.
SECTION 8 — SHIPPING AND DELIVERY
Atelier Sébeline ships to selected countries and regions.
Shipping charges are calculated according to the product, size, finish and destination and are displayed during checkout.
Delivery estimates are provided in good faith but are estimates rather than guaranteed delivery dates. Delivery may be affected by production schedules, carrier delays, customs processing, weather, local disruptions or other circumstances outside our reasonable control.
If your artwork arrives damaged, defective or incorrect, please contact us promptly at contact@ateliersebeline.com and provide your order number and photographs showing the issue.
Please retain the artwork and packaging until your claim has been reviewed.
Nothing in this section transfers risks to you earlier than permitted by applicable law or limits your statutory rights concerning delivery.
SECTION 9 — CUSTOMS, DUTIES AND INTERNATIONAL ORDERS
International orders may be subject to customs requirements, import duties, taxes or other charges depending on the destination and fulfillment route.
Where such amounts are collected at checkout, they will be displayed as part of the order.
Where third-party charges cannot reasonably be calculated or collected in advance, additional charges may apply in accordance with applicable laws and carrier/customs requirements.
We aim to provide applicable shipping and charge information as clearly as reasonably possible before you complete your purchase.
SECTION 10 — INTELLECTUAL PROPERTY
The Atelier Sébeline website and its original content, including our brand name, logos, original artwork and designs created for the brand, graphics, text, layouts, brand photography, and other original materials, are owned by or licensed to Atelier Sébeline and are protected by applicable intellectual property laws.
You may use our website for personal, non-commercial purposes only.
You may not reproduce, distribute, commercially exploit, modify or republish our proprietary materials without prior written permission, except where permitted by law.
Nothing in these Terms transfers ownership of your original photographs to Atelier Sébeline.
SECTION 11 — THIRD-PARTY SERVICES AND TOOLS
Certain features of the Services may be provided by third parties, including Shopify, payment processors, production partners and shipping providers.
Your use of certain third-party services may also be subject to their respective terms and privacy policies.
We are not responsible for third-party websites or services outside our reasonable control, except to the extent responsibility cannot legally be excluded.
SECTION 12 — THIRD-PARTY LINKS
Our website may contain links to third-party websites.
We are not responsible for the content, accuracy, policies or practices of third-party websites. You should review the applicable terms and policies before using third-party services or making purchases through them.
SECTION 13 — RELATIONSHIP WITH SHOPIFY
Atelier Sébeline is powered by Shopify, which enables us to provide the Services.
However, purchases made through our store are made directly with Atelier Sébeline. Shopify is our ecommerce platform provider and is not the seller of Atelier Sébeline products.
SECTION 14 — PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Information necessary to provide the Services may also be processed by Shopify and other service providers involved in payment processing, production, fulfillment, delivery and operation of our store.
Please review our Privacy Policy for additional information regarding the collection, use and disclosure of personal information.
SECTION 15 — REVIEWS AND FEEDBACK
If you voluntarily provide a review, testimonial or other feedback about Atelier Sébeline, you confirm that you have the right to provide that content.
We may use reviews and feedback for legitimate business and promotional purposes, subject to applicable law.
Providing feedback or a review does not automatically give Atelier Sébeline permission to publicly use your personal photograph or personalized artwork. Separate permission is required for such use.
SECTION 16 — ERRORS AND INACCURACIES
We make reasonable efforts to ensure that information presented through the Services is accurate.
Occasionally, typographical errors, technical errors or inaccuracies may occur.
Where an error affects an order, we will address the situation in accordance with applicable law. Nothing in this section permits Atelier Sébeline to cancel, alter or refuse an otherwise binding consumer transaction where doing so would be prohibited by applicable law.
SECTION 17 — PROHIBITED USES
You may not use the Services for unlawful, fraudulent or malicious purposes or in a manner that infringes the rights of Atelier Sébeline or any third party.
You may not interfere with the security or operation of the Services, distribute malicious code, collect personal information unlawfully, impersonate another person or use the Services to infringe intellectual property, privacy or other legal rights.
SECTION 18 — AVAILABILITY OF SERVICES
We may update, modify or discontinue website features, products or services from time to time.
Any changes affecting an existing order will be handled in accordance with the agreement made with the customer and applicable consumer protection laws.
SECTION 19 — DISCLAIMER
We make reasonable efforts to provide accurate information and high-quality personalized products.
To the extent permitted by applicable law, the Services are provided without warranties beyond those expressly stated by Atelier Sébeline.
However, nothing in these Terms excludes, restricts or modifies any legal warranty, consumer protection or other right that cannot legally be waived or limited.
SECTION 20 — LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Atelier Sébeline will not be liable for indirect, incidental, special or consequential losses arising from use of the Services where such liability may lawfully be limited.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law, including applicable consumer protection legislation.
SECTION 21 — INDEMNIFICATION
To the extent permitted by applicable law, you agree to be responsible for claims arising from content you provide to Atelier Sébeline where you did not have the necessary rights or permission to provide that content.
This includes third-party claims arising from your unauthorized use of photographs, images or other protected material supplied for creation of your personalized artwork.
SECTION 22 — SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will continue in effect.
SECTION 23 — GOVERNING LAW
These Terms and your use of the Services are governed by the applicable laws of Québec and Canada, without limiting any mandatory consumer protection rights that apply to you based on your place of residence.
Nothing in these Terms requires a consumer to waive a jurisdiction, remedy or protection that cannot legally be waived under applicable law.
SECTION 24 — CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business practices or legal obligations.
The current version will be published on this page with any changes taking effect as permitted by applicable law.
Material changes will be communicated where required by law.
